This amendment would have prevented the Environmental Protection Agency from using aerial surveillance in order to monitor agricultural operations‘ compliance with clean water regulations. This tool is used primarily to monitor large animal feeding operations, where manure spills into water bodies are easily identifiable from the air. Congress does not restrict how the agency monitors other industries.
